Because everyone, including Albert Sendrey and his children Christopher and Jenny, expected the Federal Republic of Germany to prevail at trial, in an attempt to protect his assets, Albert mortgaged his home and invested all the proceeds into a restaurant that never opened. Instead the funds were diverted to a different restaurant, and Albert lost all his savings. Machat sued the restaurant entrepreneurs for fraud and elder abuse (Albert was in his nineties) and obtained treble damages and judgments of a million dollars against the defendants.
